San Diego, Orange County and Palm Springs Motorcycle Accident Lawyer – Possible Future Laws to Prevent Motorcycle Accidents
When you’ve had a motorcycle accident in Orange County, California, or San Diego, CA, whether it is in Newport Beach, Laguna Beach, Huntington Beach, Irvine, Anaheim, Fullerton, Santa Ana, Mission Beach, Pacific Beach, Ocean Beach, Mission Valley, Carlsbad or Oceanside, and whether your motorcycle crash occurs in Rancho Cucamonga, Ontario, Riverside, San Bernardino, Fullerton, Palm Springs, or Palm Desert, you begin to wonder if the legislators of California are doing anything to prevent motorcycle accidents from happening.
I had heard that California’s state legislators were rushing to pass laws to prevent motorcycle accidents, and I wanted to try to obtain an insight into the minds of the legislators. So I called one of my state Senators and found I was in for a big surprise.
“So is the law against texting going to apply to motorcycle riders?” I asked.
“We’re working on it” the Senator exclaimed. “Just as soon as we can figure out if it’s possible to text while on a motorcycle.”
“What have you decided to outlaw in the meantime?” I asked.
“For one thing, no more use of firearms,” the Senator said.
“Why is that just being applied to motorcyclists?” I asked.
The Senator looked at me like I was crazy. “Everyone knows that motorcyclists carry weapons.”
“What else are you prohibiting?” I asked and rolled my eyes.
“Crossbows, RPGs, pipe bombs and pit bulls,” the Senator said.
I could see the pattern here. The Senators still thought everyone who rides a motorcycle was part of a rebel motorcycle gang. Still it was the last item that caught me by surprise. “Pit bulls?” I asked.
“Not just pit bulls,” the Senator said. “We’re not going to allow any more hooligan tricks of any kind. No handstands, no circus tricks, and no animals riding on the back.”
“What about eating and drinking coffee?” I asked.
The Senator frowned. “That’s going to apply just to cars. Motorcycles don’t have cup holders.”
“You know, with the price of gas, there are more and more regular car drivers switching to motorcycles to save gas,” I said.
“You think we need to apply the new car driving rules to motorcycle riding?” the Senator asked.
“That depends,” I said. “What are the new rules?”
“No driving while playing video games,” the Senator said.
“That would be pretty hard to do with one hand,” I said.
“No grooming,” the Senator said.
“Again, that’s pretty hard to do with a helmet on your head,” I said.
“No more reading newspapers while driving,” the Senator said.
“That’s almost impossible while riding in the wind on a motorcycle.”
“You see, that’s why we’re thinking about instituting new rules just for motorcyclists,” the Senator said.
“What are you going to tell motorcycle riders they can’t do?” I asked.
“We think we’re going to have to outlaw everything that could possibly distract the riders from the road,” the Senator said.
“You don’t think motorcycle riders will use common sense?” I asked.
“Do drivers of cars use common sense?” the Senator asked rhetorically.
“So what’s on your list of things to outlaw?”
“No eating, unless the food is from specific restaurants.”
I looked at the Senator, who shrugged and said “Lobbyists.”
“What else?”
“No coffee unless it’s from specific coffee shops, only certain types of jackets, helmets, goggles, and only skimpy outfits for the girls,” the Senator said and smiled.
I raised my eyebrows.
“What can I say,” the Senator said. “Most of the lobbyists are male.”
News Note – On October 1, 2008, Governor Schwarzenegger banned motorists from texting, writing or reading messages on electronic devices. The law goes into effect January 1, 2009. Apparently the rule affects motorcyclists, even if it is virtually impossible to text with one hand.
